ORDINANCE NO. 2019-03

AN ORDINANCE AMENDING THE ORDINANCE FOR CATERING ALCOHOL PERMITS

WHEREAS, the Town currently has an Ordinance requiring a Lyman Liquor License for the granting of a catering permit; and

WHEREAS, the Town Council finds it desirable to allow other lawful liquor license holders in the area to obtain a catering permit; and

WHEREAS, the current Ordinance sets a permit fee, which needs to be amended to be set by Resolution; and

WHEREAS, the Town wishes to allow the issuance of a wine permit; and

WHEREAS, the language of the current Ordinance needs to be updated to conform with the Town’s practices.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 

3-2-3-12: MALT BEVERAGE PERMIT; WINE PERMIT; CATERING PERMIT:

  1. Malt Beverage Permit: A malt beverage permit authorizing the sale of malt beverages and/or the dispensing of malt beverages in a public area may only be issued by the town council to any responsible person or organization. No person or organization holding the special permit shall sell any alcoholic liquor other than malt beverages on the premises described on the permit nor shall any malt beverage be sold or consumed off the premises authorized by the permit.
  2. Wine Permit: A wine permit authorizing the sale of wine and/or the dispensing of wine in a public area may only be issued by the town council to any responsible person or organization. No person or organization holding the special permit shall sell any alcoholic liquor other than wine on the premises described on the permit nor shall any wine be sold or consumed off the premises authorized by the permit.

C.bConcurring Permits: Nothing in this Ordinance prevents a person or organization from simultaneously holding a malt beverage and a wine permit for the same event.

  1. Catering Permit: A catering permit authorizing the sale and or dispensing of any alcoholic beverage on Town Property may be issued by the town council to any person holding a Wyoming retail liquor license lawfully issued by an entity in Uinta, Sweetwater or Lincoln Counties, authorizing the off-premises sale of both alcoholic and malt beverages, for sales at meetings, conventions, private parties and dinners, or at other similar gatherings not capable of being held within the licensee’s licensed premises. No licensee holding a catering permit shall sell or permit consumption of any alcoholic or malt beverages off the premises described in the permit.
  2. Term; Hours Of Sale; Number Of Permits Restricted: The permits authorized for this section shall be issued for one 24-hour period subject to the schedule of operating hours provided by section 3-2-4-1 of this chapter.
  3. Application: The permits herein shall be issued on application to the town council without public notice or hearing.
  4. Fee: The fees for permits under this Ordinance shall be set by Resolution of the Town Council, payable in advance.

PUBLIC NOTICE

Uinta County School District 4 (Mountain View) will adopt new K-8 Science textbooks for implementation in 2019-2020. Curriculum discussions regarding the adoption of new textbooks have been ongoing throughout the 2018-19 school year with numerous meetings involving K-8 science teachers. After reviewing a number of science textbooks and materials and conducting on-site reviews, the committee will recommend Elevate Science, published by Pearson, at the May board meeting. Interested parents and community members may view the materials at the K-8 office or stop by the district office prior to May 14, 2019.

TOWN OF LYMAN WYOMING

Minutes of the Business Meeting held March 21, 2019

Present were Mayor Berg, Councilmembers Andy Spray, Tansy Shelton, Shane Hooton, Public Works Director Jared Crane, Chief Kathy Adams, Deputy Clerk Lisa Reis and Attorney Thayne Peterson.  Clerk Bradshaw and Councilmember Dallas Sill were excused.

Councilman Spray made a motion to approve the agenda as amended, second by Councilman Hooton, motion carried unanimously.

Councilwoman Shelton made a motion to approve the minutes of the March 7, 2019 planning meeting, work and business meetings, second by Councilman Spray, motion carried unanimously.

Councilman Hooton made a motion to approve the Lyman FFA Alumni Farmland Lease for another year, second by Councilwoman Shelton, motion passed unanimously.

ORDINANCE NO. 2019-01 AN ORDINANCE REVOKING THE ORDINANCE MANDATING TREES AND AMENDING STREETLIGHT SPACINNG IN NEW SUBDIVISIONS Councilman Spray made a motion to approve Ordinance No. 2019-01 on the third and final reading, second by Councilman Hooton, motion carried unanimously.

ORDINANCE NO. 2019-02 AN ORDINANCE REVOKING THE ORDINANCE MANDATING PARKS IN NEW SUBDIVISIONS. Councilwoman Shelton made a motion to approve Ordinance No. 2019-02 on the third and final reading, second by Councilman Spray, motion carried unanimously.

ORDINANCE NO. 2019-03 AN ORDINANCE AMENDING THE ORDINANCE FOR CATERING ALCOHOL PERMITS Councilman Spray made a motion to table Ordinance No. 2019-03 on the second reading, second by Councilwoman Shelton, motion carried unanimously.
