Councilman Hooton made a motion to approve the agenda as amended, second by Councilwoman Shelton, motion carried unanimously.

Councilman Spray made a motion to approve the August 18, 2022 business meeting and work session minutes, second by Councilman Quinney, motion carried unanimously.

Mayor Berg opened the public hearing for Resolution # 2022-25 and Resolution # 2022-26

Audrey Kemp 409 W. Clark Street stated that she was in favor of the assisted living facility in Lyman.  No comments of not being in favor of this project.  Public hearing was closed.

FOR THE PURPOSE OF THE CREATION OF AN ASSISTED LIVINIG FACILITY IN THE TOWN OF LYMAN Councilman Quinney made a motion to approve Resolution # 2022-26, second by Councilman Hooton, motion carried unanimously.

Ordinance No. 2022-04 AN ORDINANCE REQUIRING AN OCCUPANCY PERMIT FOR BUSINESSES Attorney Peterson explained the need for this ordinance.  Councilman Quinney made a motion to table Ordinance No. 2022-04 on the first reading, second by Councilman Spray, motion carried unanimously.

Councilman Hooton made a motion to approve payment of $100.00 for contract service to the Uinta County Library for the Bookmark Contest, second by Councilwoman Shelton, motion carried unanimously.

Councilman Hooton made a motion to approve purchase order # 2022-16 to Carrier Corporation for a heating unit in the amount of $13,253.00, second by Councilman Spray, motion carried unanimously.

IV-2022-1-12: Petition for Change of Point of Diversion and Means of Conveyance and Change of Place of Use of the Bud Hussman and Lyda Hussman Appropriation, Permit No. 7914, adjudicated under Proof No. 24648, diverting from Henry’s Fork, tributary Green River, though the Johnson No. 2 Ditch, with a priority of July 11, 1907.                                                                                                                                               If successful this series of petitions will Change Place of Use, Change Points of Diversions and Means of Conveyance, Change the Type of Supply and Change the Use of appropriations or portions of appropriations to reflect historic irrigation practices and to facilitate installation of sprinklers.

Said petition and map are on file with accompanying submissions at the central office of the State Board of Control in Cheyenne (777-6960), with a partial set of copies available for review at the Cokeville location of the State Engineer’s Office (279-3441).  Questions about the reasons for which this petition has been filed may be addressed to the petitioner’s agent Todd Rhodes with Wyoming Water Right Consulting, Inc.   (307-347-8329).                                                                                                                          Said petition has been referred to the undersigned for a hearing as provided by Wyoming Statutes §§ 41-4-514, §§ 41-3-104, and the Wyoming Administrative Procedure Act (Wyoming Statutes §§ 16-3-101 through -115), and the Regulations and Instructions of the State Board of Control and the State Engineer.                                                                                                                                             NOW THEREFORE, a pre-hearing conference shall be convened on October 26, 2022 beginning at 9:00 A.M.  at the State Engineer’s Office at 115 Park Street Cokeville, Wyoming, at which time the petitioner and anyone whose water right may be affected by the granting of said petition may appear telephonically (by calling 1-877-875-6073) and become a party to these proceedings.  Interested parties may alternatively attend the conference in person in Cokeville.  Attorney representation is allowed, although not required, but without an attorney a party can generally only represent himself or herself.  If you wish to protest, you must appear by telephone or in person at this pre-hearing conference.  Failure of any interested person or entity to appear at this pre-hearing conference will foreclose any future opportunity to object or appear in this matter and may result in action which may adversely affect that person or person’s water rights interest. If protests are received at the prehearing conference, a contested case hearing will be scheduled. At the contested case hearing any party protesting the petition should be prepared to identify their water right(s) and show under oath and subject to cross-examination how the proposal would affect their water right(s) if the petition is ultimately granted by the Board of Control.
