TOWN OF MOUNTAIN VIEW

December 20, 2022   7:00 P.M.

The December 20, 2022 Mountain View Town Council meeting was called to order at 7:00 pm by Mayor Pro Tem Jamy Ferrin. Those present were, council members, Gina Tims, Tori Carter, and Jenny Harvey, Clerk Treasurer, Penny Robbins, Deputy Clerk, Tammy Murray, Jake Porter with Public Works, Attorney, Mark Harris and Chief of Police, Allister Bunch.

Motion by Tori Carter, second by Gina Tims to approve the agenda with the addition of approve of the December 6, 2020 meeting minutes: motion carried.

Motion by Tori Carter, second by Jenny Harvey to recess into public hearing at 7:01 pm to hear public comment on ORDINANCE 2022 - 5 AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING AMENDING AND REENACTING SECTIONS OF TITLE 16, CHAPTER 4, WATER REGULATIONS, OF THE TOWN CODE OF THE TOWN OF MOUNTAIN VIEW, WYOMING, motion carried.

Public comments by Kelly Bonner addressing apartment buildings being charged for multiple units. Dawn Manzanarez asking about the costs of her bill. Attorney Mark Harris referred to Evanston Ordinance for clarification and wording for the Ordinance.

Motion by Tori Carter, second by Jenny Harvey to reconvene regular meeting at 7:30 pm, motion carried.

Motion by Gina Tims, second by Tori Carter to approve ORDINANCE 2022 - 5 AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING AMENDING AND REENACTING SECTIONS OF TITLE 16, CHAPTER 4, WATER REGULATIONS, OF THE TOWN CODE OF THE TOWN OF MOUNTAIN VIEW, WYOMING on second reading, motion carried.

Motion by Tori Carter, second by Gina Tims to recess into public hearing at 7:35 pm to hear public comment on move ORDINANCE 2022- 6 AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING AMENDING AND REENACTING SECTIONS OF TITLE 16, CHAPTER 8, UTILITIES, SEWER REGULATIONS, OF THE TOWN CODE OF THE TOWN OF MOUNTAIN VIEW, WYOMING, motion carried

Public comment by Kelly Bonner to take into consideration the same recommendations that were presented for the water ordinance.

Motion by Tori Carter, second by Jenny Harvey to approve ORDINANCE 2022- 6 AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING AMENDING AND REENACTING SECTIONS OF TITLE 16, CHAPTER 8, UTILITIES, SEWER REGULATIONS, OF THE TOWN CODE OF THE TOWN OF MOUNTAIN VIEW, WYOMING on second reading, motion carried.

Motion by Jenny Harvey, second by Gina Tims to approve ORDINANCE 2022-7 AN ORDINANCE OF THE GOVERNING BODY OF THE TOWN OF MOUNTAIN VIEW, WYOMING AMENDING SECTION 2.24.030 A AND SECTION 2.28.190 A OF THE TOWN CODE PROVIDING FOR COMPENSATION OF THE MAYOR AND COUNCILMEMBERS OF THE TOWN OF MOUNTAIN VIEW on third and final reading, motion carried.

Motion by Tori Carter, second by Gina Tims to recess into public hearing at 7:37 pm to hear public comment on RESOLUTION 2022-15 A RESOLUTION TO AMEND RESOLUTION 2022-8 ESTABLISHING ALL FEES, COSTS AND CHARGES; SPECIFICALLY AMENDING RESIDENTIAL SEWER USAGE FOR THE REMAINDER OF 2022-2023 FISCAL YEAR, motion carried.

In public comment Town Clerk Penny Robbins explained that residential customers only being charged a sewer usage average for the months of November through February, up to a maximum of 4,000 gallons.

Motion by Jenny Harvey, second by Gina Tims to reconvene regular meeting at 7:41 pm, motion carried.

Motion by Tori Carter, second by Jenny Harvey to approve RESOLUTION 2022-15 A RESOLUTION TO AMEND RESOLUTION 2022-8 ESTABLISHING ALL FEES, COSTS AND CHARGES; SPECIFICALLY AMENDING RESIDENTIAL SEWER USAGE FOR THE REMAINDER OF 2022-2023 FISCAL YEAR, motion carried.

Motion by Tori Carter, second by Jenny Harvey to approve RESOLUTION 2022-16 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MOUNTAIN VIEW, WYOMING AUTHORIZING AND APPROVING PAYMENT OF COMPENSATION FOR THE MAYOR, TOWN COUNCILMEMBERS AND TOWN APPOINTEES TO JOINT POWERS BOARDS, motion carried.

Motion by Tori Carter, second by Jenny Harvey to approve RESOLUTION 2022-17 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MOUNTAIN VIEW, WYOMING ADOPTING THE TOWN OF MOUNTAIN VIEW PERSONNEL POLICY – 2022, motion carried.

Motion by Tori Carter, second by Jenny Harvey to approve RESOLUTION 2022-18 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MOUNTAIN VIEW, WYOMING SPECIFYING ELIGIBILITY OF POSITIONS CURRENTLY EXEMPT FROM THE WAGE AND

OVERTIME PROVISIONS OF THE FAIR LABOR STANDARDS ACT AND PERSONNEL POLICY – 2022 OF THE TOWN AS POSITIONS SUBJECT TO OVERTIME RULES AND REGULATIONS FOR THE REMAINDER OF THE 2022 FISCAL YEAR, in discussion Attorney Mark Harris explained the updated language in the new personnel policy pertaining to overtime specifying eligibility of positions exempt from the wage and overtime provisions of the Fair Labor Standards Act and Personnel Policy-2022, motion carried.

Motion by Gina Tims, second by Tori Carter to approve the December 5, 2022 minutes, motion carried.

In other council business: Mayor Pro Tem Jamy Ferrin express the great support for all of the Angel Tree gifts that the community so generously gave for our senior citizens. Mayor Pro Tem and Councilwoman Tori Carter presented outgoing Councilwoman Gina Tims with a Engraved Flag Box and bouquet of flowers in appreciation of her 10 years on the council. Thank you, Gina.

Mayor Pro Tem Jamy Ferrin adjourned the meeting at 7:55 pm.
