NOTICE IS HEREBY PUBLISHED that the Town of Lyman has accepted as completed all the work on the Heritage Barn Roofing Project according to the plans, specifications and rules set forth between the Town of Lyman and Major Roofing and Construction of Lyman, Wyoming and the contractor is entitled to settlement thereof.

Final payment will be made after the completion of publication of this Notice. The date of first publication is October 4, 2019 and the date of final statement will be on or after November 14, 2019.

Any claim or claims for work or labor due, or for materials or supplies furnished, must be accordingly filed with the Town of Lyman prior to the above published date of final settlement.

ORDINANCE NO. 2019-08

AN ORDINANCE AUTHORIZING THE REMOVAL OR DESTRUCTION OF ANIMALS THAT PRESENT A CLEAR DANGER TO THE PUBLIC, PROPERTY OR OTHER ANIMALS

WHEREAS, the Town has been tasked by State Statute to govern animals in Town; and,

WHEREAS, the current Code needs to be amended in order to allow the Chief of Police to immediately deal with threats to the public.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 

5-3A-15: DANGEROUS ANIMALS:

The Chief of Police and or their designee is authorized to immediately remove and/or destroy an animal which presents a clear and immediate danger to the public, property and/or other animals and when such removal is the only means by which public safety can be reasonably assured.

ORDINANCE NO. 2019-06

AN ORDINANCE ALLOWING CHANGES AND EXEMPTIONS TO THE BUILDING CODE BY RESOLUTION AND ONLINE REVIEW

WHEREAS, the Town has adopted the International Building Code; and,

WHEREAS, the current Ordinance needs to be amended to allow online review of the building code; and

WHEREAS, the Town has a need to modify or except certain portions of the IBC at the recommendation of the Town Building Inspector, and it is expedient to have those modifications be made by Resolution.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 

9-2-1: BUILDING CODE ADOPTED:

There is adopted by the town for the purpose of prescribing regulations for the minimum standards to safeguard life, health, property and public welfare, that certain suggested code known as the International Building Code (IBC), along with all incorporated codes contained by reference in the IBC being particularly the most recent edition of the code available to the general public, and the whole thereof, save and except such portions as are modified, deleted, added or amended pursuant to resolution by the Town Council. The IBC and the codes incorporated by reference within the IBC are incorporated in this section as fully as if set out in length in this section, and the provisions thereof shall be controlling within the town unless specifically excepted by Resolution.

9-2-6: COPIES ON FILE: 

  1. Codes: At least one copy of each code adopted in this chapter and any ordinance and resolution providing for amendments, modifications, additions or deletions in such codes shall be maintained on file in the office of the town clerk where they shall be available for public inspection during the normal office hours of the Town Clerk. In lieu of having a physical copy of each Code, the office of the Town Clerk may provide information directing the public to the on-line location of the adopted Codes
  2. Amendments; Modifications: One copy of each ordinance and resolution amending or modifying each code shall be kept with each copy of the code

ORDINANCE NO. 2019-07

AN ORDINANCE EXEMPTING SMALL ACCESSORY BUILDINGS FROM REQUIRING BUILDING PERMITS

WHEREAS, the Town has an Ordinance requiring building permits; and,

WHEREAS, the current Ordinance needs an amendment to exempt small accessory buildings;

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 

9-1-1: BUILDING PERMIT REQUIRED

  1. Small accessory buildings: Accessory buildings with a footprint less than 200 square feet and without electricity and/or plumbing are not required to have a building permit. The exemption herein does not exempt the accessory building from compliance with all other sections of the Town Code.

No other portion of Ordinance 9-1-1 shall be modified by the passage of this Ordinance.

TOWN OF LYMAN WYOMING

Minutes of the Business Meeting held September 5, 2019

Present were Mayor Berg, Councilmembers Andy Spray, Dallas Sill and Shane Hooton via phone, Police Chief Kathy Adams, Clerk Lisa Bradshaw, Public Works Director Jared Crane and Attorney Thayne Peterson.  Councilwoman Shelton was excused.

Councilman Spray made a motion to approve the agenda as amended, second by Councilman Sill, motion carried unanimously.

Councilman Sill made a motion to approve the minutes of the August 15, 2019 work and business meetings, second by Councilman Spray, motion carried unanimously.

Mayor Berg opened the public hearing for Ordinance No. 2019-06, no public comments.  Public hearing was closed.

Resolution #2019-21 A RESOLUTION APPOINTING A TOWN ENGINEER, TOWN BUILDING INSPECTOR AND TOWN ELECTRICAL INSPECTOR Councilman Sill made a motion to approve Resolution # 2019-21, second by Councilman Hooton, motion carried unanimously.

Resolution # 2019-22 A RESOLUTION OF THE TOWN OF LYMAN, UINTA COUNTY WYOMING AUTHORIZING GRANT APPLICATION FOR THE HIRING OF A SCHOOL RESOURCE LAW ENFORCEMENT Councilman Spray made a motion to approve Resolution # 2019-22, second by Councilman Sill, motion carried unanimously.

Councilman Spray made a motion to approve the Beverage Catering Permit for USANSON LLC at the Heritage Barn on September 8, 2019, second by Councilman Hooton, motion carried unanimously.

Councilman Sill made a motion to approve the investment policy with the language changes, second by Councilman Hooton, motion carried unanimously.

The council approved signing the final plat map for Kip Platts with the contingency the he would not record this until the Judge has signed the order to take Jennifer Platts off as part of Platts Construction.
