Notice is hereby given that the Board of Uinta County Commissioners are considering a Land Use District Change (Zone Change) and Subdivision Permit for a tract of land in Section 23, T15N, R120W.  The application would allow a change from the Agricultural/Resource/Development (ARD) Land Use District to the Industrial (I) Land Use District for the development of a two lot industrial subdivision entitled the Uinta County Industrial Park # 1.

Minutes of the Business Meeting held November 5, 2020

Present were Mayor Berg, Councilmembers Tansy Shelton, Dallas Sill and Shane Hooton, Clerk Lisa Bradshaw, Public Works Director Jared Crane, Police Chief Kathy Adams and Attorney Thayne Peterson. 

Councilman Hooton made a motion to approve the agenda, second by Councilwoman Shelton, motion carried unanimously.

Councilman Sill made a motion to approve the minutes of the October 15, 2020 business meeting and work session, second by Councilman Hooton, motion carried unanimously.

Public Hearing Ordinance No. 2020-06.  Mayor Berg opened the public hearing, no comments.  Mayor Berg closed the public hearing.

 ORDINANCE NO. 2020-06 AN ORDINANCE IMPOSING A LODGING TAX.  Councilwoman Shelton made a motion to approve Ordinance No. 2020 -06 on the second reading, second by Councilman Sill, motion carried unanimously.

RESOLUTION # 2020-25 ACCEPTING CERTIFIED ANNEXATION PETITION ORDERING TOWN OFFICIALS TO EFFECTUATE ANNEXATION.  Councilman Sill made a motion to approve Resolution # 2020-25, second by Councilman Hooton, motion carried unanimously.

Councilwoman Shelton made a motion to approve the One Day Malt Beverage Permit for Jose Luis Sandoval at the Heritage Barn on November 7, 2020, second by Councilman Hooton, motion carried unanimously.

Councilman Hooton made a motion to approve purchase order 2020-14 for Maxfield Construction in the amount of $9,506.00, second by Councilman Sill, motion carried unanimously.

ORDINANCE NO. 2020-06

AN ORDINANCE IMPOSING A LODGING TAX

WHEREAS, the Wyoming State Legislature has imposed a 5% sales tax on lodging and hotel services effective January 1, 2021; and

WHEREAS; the Legislature earmarked the revenue from this tax for the purpose of promoting travel and tourism; and

WHEREAS; pursuant to Wyoming Statute § 39-15-111(p)(ii)(B)(II), if the Town imposes its own lodging tax under Wyoming Statute § 39-15-211(a)(ii)(B), the taxes shall be coextensive and payed to the municipality rather than the State; and

WHEREAS, Wyoming Statute § 39-15-204(a)(ii) allows the Town to impose up to 2% sales tax on lodging in the Town; and

WHEREAS, Pursuant to 39-15-211(a)(ii)(B), 90% of the Town’s collected revenue shall be used to promote tourism in the Town, and 10% shall be deposited in the general fund; and

WHEREAS, 39-15-203(a)(ii)(F) mandates that the Town notify the Department of Revenue within 30 days of passage of this Ordinance and annually thereafter and provide a list to the Department of all persons selling lodging services within the Town.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LYMAN, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY:

CHAPTER 5

SALES TAX

3-5-1: LODGING TAX

  1. The Town hereby imposes, pursuant to Wyoming Statute § 39-15-204(a)(ii), a two percent (2%) excise tax on all lodging services, as defined by Wyoming Statute § 35-15-101, provided in the Town.
  2. This excise tax shall be effective on January 1, 2021 and remain in effect unless and until this excise tax represents an additional tax burden on the provider of lodging services over and above the tax imposed by the State of Wyoming.
